To ensure the safety of the chemical products exported in relation to human health and the environment, Prisma Chemicals B.V. has successfully complied with the regulations outlined in the REACH Legislation, which holds significance within the European Union member states.
The REACH Legislation, designated as 1907/2006 (EC), constitutes a European Parliament and Council Legislation that encompasses the registration, evaluation, authorization, and restriction of chemicals (REACH). It gained approval from the European Parliament on 18 December 2006 and came into effect on 1 June 2007.
A key provision within the REACH Legislation is Article 8, which pertains to the concept of an “only representative.” This refers to a legal or natural entity located outside the European Union that engages in the importation of products into the Union. This entity may encompass the production of materials found in goods or pharmaceuticals, the formulation of pharmaceuticals, or the manufacturing of goods. Such an entity has the authority to designate a legal or natural entity within the Union as its representative. This arrangement allows the designated representative to fulfill importation requirements as outlined in Article 8, subject to a mutually agreed-upon arrangement.
Simultaneously, the designated representative is obligated to adhere to all importation requirements stipulated within the REACH Legislation. In instances where a manufacturer situated outside the Union is involved, they are required to inform other importers within the same supply chain regarding this authorization. Consequently, these importers are categorized as downstream users, in accordance with the objectives outlined in the REACH Legislation.
Prisma Chemicals B.V., as a producer situated outside the European Union, has meticulously satisfied the prerequisites of the Legislation.
